Introduction

Butter Studios Inc. (“Butter,” “we,” “us,” or “our”) provides a creative platform that allows individuals and teams to create, edit, generate, manage, collaborate on, and export videos, images, motion graphics, templates, components, and other creative content.

This Privacy Policy explains how we collect, use, disclose, and protect personal information when you use our websites, applications, creative tools, artificial intelligence features, integrations, and related services, collectively referred to as the “Services.”

Information We Collect

The information we collect depends on how you use Butter.

Information You Provide

We may collect information you provide directly to us, including:

  • your name, email address, profile information, login credentials, and account preferences;

  • your company, job title, workspace, and team membership;

  • billing information, subscription information, and transaction details;

  • messages, feedback, support requests, survey responses, and other communications with us; and

  • information you provide when participating in events, promotions, research, or managed services.

Payment card information is processed by our payment providers. Butter does not store complete payment card numbers.

Content You Provide

We collect and process content that you upload, import, create, edit, generate, or share through Butter, including:

  • images, videos, audio, graphics, fonts, logos, and other brand assets;

  • text, captions, transcripts, product information, reviews, and marketing copy;

  • templates, Blocks, components, projects, timelines, code, and project settings;

  • prompts, instructions, references, and other information submitted to AI-powered features;

  • outputs generated through the Services;

  • comments, approvals, feedback, and collaboration activity; and

  • associated metadata, such as file type, dimensions, duration, creation date, and editing history.

We refer to this information as “User Content.”

You are responsible for ensuring that you have the rights and permissions necessary to provide User Content to Butter.

Information Collected Automatically

When you use the Services, we may automatically collect:

  • IP address and approximate location;

  • browser, device, and operating-system information;

  • login, session, and authentication information;

  • pages, tools, templates, and features you access;

  • actions you take within projects;

  • rendering, generation, and export activity;

  • referral information;

  • dates, times, and duration of use;

  • crash reports, diagnostics, and performance logs; and

  • security and fraud-prevention information.

Information From Third Parties

We may receive information from third parties when you:

  • sign in using Google or another authentication provider;

  • join a workspace through an invitation;

  • connect Butter to another service;

  • import assets or information through an integration;

  • purchase a subscription through a payment provider; or

  • interact with Butter through a referral, marketing, or analytics provider.

The information we receive depends on the permissions you grant and the third party’s policies.

How We Use Information

We may use information to:

  • create and manage accounts and workspaces;

  • provide, operate, maintain, and secure the Services;

  • store, process, edit, generate, render, and export User Content;

  • provide collaboration, sharing, and workspace-management features;

  • provide AI-powered features;

  • personalize the Services for you or your workspace;

  • process payments and manage subscriptions;

  • respond to questions and provide customer support;

  • understand how the Services are used;

  • diagnose errors and improve reliability and performance;

  • develop and improve tools and features;

  • prevent fraud, abuse, security incidents, and violations of our agreements;

  • send account, billing, security, and service communications;

  • send marketing communications where permitted;

  • comply with law and protect our rights; and

  • create aggregated or de-identified information that does not reasonably identify an individual or organization.

Artificial Intelligence Features

Some Butter features use artificial intelligence provided by Butter or third-party service providers.

When you use these features, we may process and transmit the information needed to complete your request, including prompts, instructions, images, video, audio, text, project information, and other User Content you select.

Third-party AI providers process this information to provide the requested functionality to Butter. The specific providers used may vary depending on the feature, model availability, performance, and customer plan.

Butter may use information about how AI features are used, along with aggregated or de-identified information, to evaluate and improve the Services.

Butter does not use private User Content to train general-purpose AI models that benefit other customers unless you or your organization gives us permission.

Butter may use User Content and your interactions with the Services to personalize features and recommendations for you or your workspace. We do not use one customer’s private User Content to personalize another customer’s workspace.

AI-generated outputs may be inaccurate or incomplete. You are responsible for reviewing outputs before using or publishing them.

How We Disclose Information

We may disclose information to the following categories of recipients.

Service Providers

We work with service providers that help us operate Butter, including providers of:

  • cloud hosting and storage;

  • authentication;

  • payment processing;

  • rendering and content delivery;

  • artificial intelligence;

  • analytics and performance monitoring;

  • email and communications;

  • customer support; and

  • security and fraud prevention.

These providers may process information only as necessary to provide services to Butter, subject to applicable contractual restrictions.

Integrations You Choose

When you connect Butter to another service, import or export information, or publish content through an integration, we disclose information at your direction.

Information sent to a third-party service is governed by that service’s own privacy policy and terms.

Workspace Members

User Content, account information, comments, activity, and other information may be visible to members and administrators of your workspace according to its settings and permissions.

Workspace administrators may be able to manage users, projects, content, integrations, permissions, usage, and billing.

Legal and Safety Reasons

We may disclose information when we reasonably believe disclosure is necessary to:

  • comply with applicable law or valid legal process;

  • respond to lawful requests from courts, regulators, or government authorities;

  • investigate fraud, abuse, security incidents, or unlawful conduct;

  • enforce our agreements and policies; or

  • protect the rights, safety, property, or security of Butter, our users, or others.

Business Transactions

We may disclose or transfer information in connection with a merger, financing, acquisition, reorganization, sale of assets, bankruptcy, or similar business transaction.

At Your Direction

We may disclose information for other purposes with your consent or at your direction.

Butter does not sell personal information in exchange for money.

Cookies and Analytics

Butter and its service providers may use cookies, local storage, pixels, and similar technologies to:

  • keep you signed in;

  • remember your preferences;

  • secure the Services;

  • understand how the Services are used;

  • identify errors;

  • measure performance; and

  • understand the effectiveness of Butter’s communications and marketing.

Some third-party providers may collect information through these technologies when you use our website or Services.

You can control cookies through your browser settings and any cookie controls we make available. Disabling certain cookies may affect the operation of the Services.

Our Services do not currently respond to browser “Do Not Track” signals. Where applicable law requires us to recognize another browser-based privacy preference signal, we will process it as required by law.

Data Retention

We retain personal information for as long as reasonably necessary to:

  • provide and maintain the Services;

  • maintain your account and projects;

  • complete transactions;

  • comply with legal, tax, accounting, and contractual requirements;

  • prevent fraud and security incidents;

  • resolve disputes; and

  • enforce our agreements.

The applicable retention period depends on the type of information, why it was collected, the sensitivity of the information, customer instructions, and legal requirements.

When you delete your account or request deletion, we will delete or de-identify personal information that we are not required or permitted to retain.

Deleted information may remain temporarily in restricted backups before being overwritten through our normal backup processes.

We may retain aggregated or de-identified information where it can no longer reasonably identify you or your organization.

Your Choices and Rights

Depending on where you live, you may have the right to:

  • access personal information we hold about you;

  • correct inaccurate personal information;

  • request deletion of personal information;

  • receive a portable copy of certain information;

  • object to or restrict certain processing;

  • withdraw consent where processing is based on consent;

  • opt out of certain marketing communications; and

  • complain to a privacy or data-protection authority.

We may need to verify your identity before completing a request.

If you use Butter through an organization-controlled workspace, your organization may control the information in that workspace. We may refer your request to the applicable organization.

You can unsubscribe from marketing emails through the unsubscribe link in the message. You will continue to receive communications necessary to operate your account, such as billing, security, and service notices.

Information for European and UK Users

For users in the European Economic Area, United Kingdom, and Switzerland, Butter processes personal information under one or more of the following legal bases:

  • performing our contract with you or your organization;

  • pursuing our legitimate interests in operating, securing, supporting, and improving the Services;

  • complying with legal obligations; and

  • your consent, where required.

Butter is based in the United States. Your information may be transferred to and processed in the United States and other countries where Butter or our service providers operate.

Where required, we use lawful safeguards for international data transfers, such as standard contractual clauses.

You may have the right to lodge a complaint with the data-protection authority where you live or work.

Business and Enterprise Customers

When Butter processes personal information on behalf of a business or enterprise customer, that customer may act as the controller of the information and Butter may act as its processor or service provider.

Our processing may also be governed by the customer’s agreement with Butter or a Data Processing Addendum. If that agreement conflicts with this Privacy Policy regarding customer-controlled information, the applicable agreement will control.

Security

Butter uses reasonable administrative, technical, and organizational safeguards designed to protect information from unauthorized access, disclosure, alteration, loss, and misuse.

No system is completely secure. We cannot guarantee that information will never be accessed, disclosed, altered, or lost without authorization.

You are responsible for protecting your credentials and promptly notifying us if you believe your account has been compromised.

Children

The Services are not directed to children under 13, and Butter does not knowingly collect personal information from children under 13.

If you believe a child under 13 has provided personal information to Butter, contact us at privacy@butter.video.

Third-Party Services

The Services may contain links to or integrations with third-party websites, applications, platforms, and services.

Butter does not control and is not responsible for the privacy or security practices of those third parties. Review their privacy policies before providing information or connecting an account.

Changes to This Privacy Policy

We may update this Privacy Policy as our Services, practices, and legal obligations change.

We will post the updated policy and change the “Last Updated” date above. If we make a material change, we will provide additional notice where required, such as through email or an in-product notice.

Changes will apply prospectively from the stated effective date.
